DonkyCapital Terms and Conditions

Welcome to DonkyCapital. By accessing and using our platform, you accept these Terms and Conditions.

1. Contracting Party

The contract is entered into between the registered user ("Customer") and DonkyCapital, with registered office in Italy, email: [email protected]

2. Scope of Application

These terms govern the use of DonkyCapital, its online services, and mobile app. Future changes will be communicated to the Customer, who may accept them or withdraw from the services.

3. Contract Subject

DonkyCapital is a fintech platform that allows registered users to view financial data and manage simulated portfolios.

  • We do not execute real financial transactions.
  • Some data comes from external sources and may be updated or corrected.
  • We offer both free and paid services.

4. Registration and Account

  • Using the services requires registration.
  • The user guarantees that the data provided is truthful and up to date.
  • Each account is personal: do not share credentials with third parties.
  • DonkyCapital reserves the right to suspend or delete accounts for violations of the terms.

5. User Obligations

  • Do not damage the infrastructure or extract data illegally.
  • Do not publish offensive, illegal, or discriminatory content.
  • Keep your personal data up to date.

6. Duration and Termination of Contract

  • The contract has an indefinite duration, with automatic renewal for paid subscriptions.
  • You can withdraw at any time.
  • DonkyCapital may suspend or discontinue services for contractual violations or legal reasons.

7. Subscription Plans

  • DonkyCapital offers a free plan (Free) and two paid plans (Standard and Premium).
  • Paid services are clearly indicated on the site.
  • Payments are processed by Creem (Creem, Inc.), a third-party payment provider. By purchasing a paid plan, you also accept Creem's terms of service.
  • DonkyCapital does not store credit card or payment instrument data.
  • Prices are shown inclusive of applicable taxes where required by law.

8. Renewal and Cancellation

  • Subscriptions renew automatically at the end of each billing period unless canceled in advance.
  • To cancel the automatic renewal, go to your Profile and select "Cancel renewal". The cancellation takes effect at the end of the current paid period.
  • Cancellation does not result in immediate loss of access: you will continue to have access to the paid features until the end of the period already paid for, after which the account will revert to the Free plan.
  • No refunds are provided, in whole or in part, for unused periods of the current subscription, including annual plans.

9. Price Changes

  • DonkyCapital may change subscription prices with at least 30 days' notice communicated by email.
  • The first renewal following the notice will be charged at the new price.
  • If you do not accept the new price, you may cancel the automatic renewal before the current period expires.

10. Payments

  • Payments are processed exclusively by Creem (Creem, Inc.).
  • The user is responsible for any additional charges or missed payments.

11. Intellectual Property

All platform content is protected by copyright and trademarks. The user retains rights to their own content but grants DonkyCapital a license to use and promote public content.

12. Electronic Communication

All communications occur primarily via email or platform. Postal mail is used only when legally necessary.

DonkyCapital may send automated communications based on your platform usage, including welcome messages, activity reminders, portfolio performance summaries, and market alerts. These communications form part of the service provided under these Terms.

You may unsubscribe from non-essential communications at any time using the "Unsubscribe" link included in every email, or by updating your notification preferences in your account settings. Unsubscribe requests are processed within 48 hours. Transactional communications (such as password resets and account security alerts) cannot be disabled.

13. Right of Withdrawal

  • Consumers: 14 days to withdraw without reason.
  • In case of withdrawal, services received must be returned or economically compensated if used before revocation.

14. Liability Limitations

  • DonkyCapital does not guarantee completeness or accuracy of data.
  • Not responsible for financial damages arising from use of the platform.
  • The user is responsible for their own violations and will hold DonkyCapital harmless from third-party claims.

15. Assignment Prohibition

The user's rights towards DonkyCapital cannot be assigned without consent.

16. Applicable Law and Jurisdiction

  • Italian law.
  • Competent court: user's residence for consumers; Verona court for other users.

17. Severability Clause

If a provision is invalid, the others remain valid. The invalid provision will be replaced by one that reflects the original intent.

18. AI Insight Feature

18.1 Nature of the service. AI Insight is a conversational AI assistance feature that processes your aggregated portfolio profile (asset class allocation, geographic distribution, currency exposure and summary metrics) to answer financial information questions. Responses generated by AI Insight are purely informational and do not constitute financial advice, investment recommendations, or offers to buy or sell financial instruments under MiFID II or any other applicable regulation.

18.2 Usage limits. Access to AI Insight is subject to usage limits (number of messages or tokens per period) defined based on the user's subscription plan. DonkyCapital reserves the right to modify such limits with reasonable notice.

18.3 Response accuracy. Responses generated by AI may contain errors, inaccuracies or outdated information. The user is responsible for independently verifying any information before making financial decisions. DonkyCapital does not guarantee the accuracy, completeness or suitability of generated responses.

18.4 Data transmitted. To generate responses, AI Insight transmits a synthetic portfolio profile to the AI model provider. Individual transactions and direct identifying data are not transmitted. See the Privacy Policy for details on data processing.

18.5 Disclaimer of liability. DonkyCapital is not responsible for investment decisions made based on AI Insight responses, nor for any financial losses arising from use of the feature.
